Research on the Standardization of Disposal of Involved Assetsin Criminal Litigation Procedures

Abstract: To effectively punish crimes, play a role in prevention and education, and maintainsocial order and stability, the results pursued in criminal case investigation, prosecution and trialdo not merely remain at the level of punishing the defendant. In the criminal procedure, thereshould be responses to the property owned by the defendant, involved in the criminal act andthe resul, and corresponding handling results. This is not only an inherent requirement of fairjustice but also a legal duty that the people's courts, as the state's judicial organs, should fulfill.In criminal judicial practice, the lack of unified legal norms for the disposal of involved assets,as well as issues such as inconsistent rights and responsibilities and untimely disposal,have ledto numerous obstacles in the handling of involved assets. Therefore, this study systematicallyanalyzes the regulation and improvement paths for the classification refinement, scopeclarification, and behavior standardization of the disposal of involved assets in criminal cases,especially during the trial and enforcement stages of such cases.
