The Legal Application of Voice Wake-Up Words from the Perspective ofIntellectual Property Rights

[Abstract]: Voice wake-up, as one of the key technologies driving the rapid development of artificialintelligence, plays an irreplaceable and significant role in human-computer interaction products.However, in China, the legal positioning of voice wake-up words is still not very clear. In practice, the"Anti-Unfair Competition Law" is often used for general protection, but the protection provided by the"Anti-Unfair Competition Law" can only be regarded as a temporary measure. The protectionprovided by written trademarks and sound trademarks also has their own drawbacks. Throughanalyzing cases of voice wake-up words in judicial practice, combined with the principles of voicewake-up and the nature of voice wake-up words, while acknowledging the importance of protectingvoice wake-up words, it is determined that voice wake-up words play a role in distinguishing differentgoods and services in specific applications, and essentially possess the function of a trademark. In thefuture, the content of Article 8 of the "Trademark Law" should be revised to solve the protection issueof voice wake-up from the source.
